MAN JAILED 7 DAYS WITHOUT FINE FOR INSULTING MAGISTRATE

MBABANE – A man has been sentenced to seven days without an option of a fine after he insulted Senior Magistrate Phathaphatha Mdluli.

Brian Qwabe was appearing in court with the mother of his child after failing to pay maintenance and he told Magistrate Mdluli that he communicated with the mother of his child, who is also his wife, secretly out of court after hours.

After saying these words Magistrate Mdluli asked if he had heard that he had insulted him and was disrespecting the court? In response Qwabe stated that he did not see how it was an insult. During this time Qwabe took out his mobile phone and chatted on whatsapp as if nothing was bothering him.

“This all started as a peace binding matter and you brought it this far into a maintenance matter as you entertained her when she started talking about me not paying maintenance. You want to mix things which do not involve our marriage. You communicate after hours with my wife when we are not in court and this is why I am not heard when I explain my side of the story,” Qwabe said, raising his voice.

The couple first appeared at the magistrates court for a peace binding order after Qwabe allegedly came from Pigg’s Peak to harass his wife at the police camp in Mbabane.

Qwabe is employed by Sky Limit and the mother of is a police officer based at King Mswati III International airport. They then reached an agreement that he would be able to see his child through his mother because the court  had ordered that he should stay away from the police camp and the applicant. Senior Magistrate Mdluli’s clerk warned Qwabe yesterday to listen to what the court was saying to him but he continued ignoring the warnings until a police officer was called to arrest him. Senior Magistrate Mdluli then asked the clerk to prepare a committal for Qwabe so he could be sent to Sidwashini where he would start serving his seven days immediately.
