MAN RELOCATED FOR HIGHWAY WANTS OVER E1.6M FROM GOVT

MBABANE – A former resident of Motshane who was relocated to Nkoyoyo during the construction of the Mbabane-Ngwenya freeway is demanding over E1.6 million from government.


Solomon Maphanga alleged in his amended particulars of claim that TTA Civils (Pty) Ltd, acting on instructions of WBHO Swaziland (Pty) Ltd who had also been instructed by government, constructed the house he now occupies in Nkoyoyo in an unprofessional manner.    

        
Maphanga alleged that he concluded a written agreement with government on July 7, 2006 that he would be relocated to his new homestead at Nkoyoyo with his family and he would be further paid an amount of E400 000 as compensation for all other buildings, fruit trees and vegetation.
According to the agreement the parties entered into, Maphanga’s new house was to be constructed to the same specifications as the one he occupied at Motshane. The veracity of these allegations is still to be tested in court.


Also, the borehole, steel stand for a water reservoir, chain link fence and an access road among other things, would be replaced in that they were to be constructed at Maphanga’s new homestead at Nkoyoyo.


Government was represented by former Principal Secretary in the Ministry of Public Works and Transport Evart Madlopha while Maphanga represented himself when the agreement was concluded.


He alleged, in the particulars of claim, that government failed to perform all work in a professional manner or to comply with the expectations in that the house he was advised to occupy in July 2009 has cracks inside and outside at some of its corners.
Maphanga also alleged that the roof tiles are uneven, wavy and were poorly placed resulting in rain water to leak through causing damage to the ceiling.
