LAWYER NONCEDO WITHDRAWS FROM REPRESENTING JUDGE MPENDULO

MBABANE – Lawyer Noncedo Ndlangamandla from Mabila Attorneys has withdrawn her services as the attorney representing Judge Mpendulo Simelane.


Ndlangamandla has since filed a notice of withdrawal as attorney on record for the judge.  The reasons for her withdrawal were not outlined in the notice of withdrawal.
Ndlangamandla is the one who successfully moved a bail application on behalf of Judge Simelane before Judge Qinisile Mabuza.


Judge Simelane was arrested by the Anti Corruption Commission (ACC) along with Judge Jacobus Annandale, High Court Registrar Fikile Nhlabatsi and former Minister of Justice and Constitutional Affairs Sibusiso Shongwe. 
The judge (Simelane) is alleged to have refused to recuse himself in the matter involving Chief Justice (CJ)Michael Ramodibedi against the Swaziland Revenue Authority.  It alleged that Simelane was involved in the matter while he was still a High Court registrar, hence he should have recused himself.


Judge Simelane, Judge Annandale and Nhlabatsi were each admitted to a bail of E50 000 but were, however, ordered to each pay E10 000 cash and provide surety for the remaining amount.
The former minister was, however, denied bail after Judge Mabuza found that he was a flight risk
Lawyer Mbuso Simelane had also withdrawn as an attorney representing the CJ in his matter against SRA.


The reasons for his withdrawal were also not outlined in the notice of withdrawal he filed with the Supreme Court Registrar.
Simelane has been all along representing the CJ in this matter which he won before Judge Mpendulo Simelane.
This is in the same matter which led to Judge Simelane’s arrest by the ACC.


Judge Simelane together with the CJ is facing three charges of defeating the ends of justice, abusing power and conflict of interest.

The CJ is said to have allocated the matter to Judge Simelane despite knowledge that while he (Simelane) was a Registrar of the High Court he had engaged SRA on the very same case on his behalf. Judge Simelane ordered SRA to pay back E128 000, which the authority deducted from the CJ’s gratuity.
