The chief is also an appointed Member of Parliament (MP).

Other respondents in the matter are the Registrar of Births, Marriages and Deaths and the Attorney General.
In her application, Hlobisile stated that their marriage was solominised on May 1, 2004 at Ntfonjeni in the northern Hhohho region. She said the marriage still subsisted and one child was born of it, a boy, born on December 9, 2004. Hlobisile further informed the court that the minor child resided with her.

“During the currency of the marriage, the first respondent (Chief Magudvulela), with the intention of terminating the marriage relationship, committed the following unlawful acts:  On August 28, 2007, when I returned from work, I found the master bedroom locked. All my clothes were loaded in a washing basket and a bedroom suite, which I had purchased, was dismantled and placed in a heap,” she alleged. These are allegations contained in an affidavit whose veracity is still to be tested in court. She alleged that her clothes were then placed outside the house.

Hlobisile further submitted that when she called Chief Magudvulelela on his mobile phone to inquire why her clothes were outside, he informed her that he had done that purposely and she should take them and leave. “In the premises, the first respondent (Chief Magudvulela) evicted me from the matrimonial home.
