BHADALA ORDERED TO PAY E300 000 TO EX-WIFE

MBABANE – Central Bank of Swaziland senior Manager Bhadala Mamba has been ordered to pay a sum of E300 000 into the account of his ex-wife.


Mamba was ordered by the court to deposit this amount into the account of his ex-wife Tsabile within 30 days.
He was further ordered to contribute a sum of E8 000 per month as maintenance, which would increase annually in line with the consumer price index.


This order was issued by High Court Judge Mumcy Dlamini after hearing the submissions of both parties’ attorneys and by consent between Mamba and his former wife.
It was further agreed by the parties that the house described as Lot No.1396, situated in Beverly Hills, Mbabane be transferred to Tsabile’s name within 30 days.


Mamba was also ordered to pay half of the savings (permanent shares) at Building Society into Tsabile’s account within 30 days.
This, after Mamba was taken to court by his ex-wife over assets of their joint estate. She was seeking an order directing Mamba to disclose fully the assets vesting in the Maja Family Trust and the benefits accrued to it since its formation.


She also wanted the court to declare that the benefits which accrued to the Maja Family Trust were benefits of their joint estate, including the credit balance in the Trust bank account.


Tsabile was further seeking an order directing her ex-husband to make a further contribution of E156 400 towards her costs.
In her application, she stated that she was currently a resident in the State of Maryland in the United States of America.
She informed the court that on July 5, 1996, they got married to each other by civil rights and in community of property and two children were born out of the marriage.


Tsabile said during the course of their marriage, they acquired several properties, among which was a vacant plot in Hhohho and a house in Extension No.11 (Thembelihle Township).
She claimed that they also beneficially owned another house at Beverly Hills, which they bought in 2002 for E500 000. 
She told the court that this house was fully paid off when they were in the USA.


“In 2002, we left Swaziland to live in the USA because the respondent (Bhadala) had been seconded to the World Bank.
“While living there, we experienced marital problems which left me with no option but to institute divorce proceedings in the USA where I am currently residing with our children,” she stated.


She said the marital problems between them also resulted in the divorce proceedings at the High Court of Swaziland.
“Prior to the aforesaid proceedings before this honourable court, I had myself instituted divorce proceedings in the USA. The latter proceedings terminated in a divorce decree which was issued on July 14, 2009,” she stated


She alleged that a trust was created without her knowledge and Mamba transferred their joint assets into the trust.
“I pause to mention that, at about the same time of the establishment of the trust, the applicant unilaterally adopted three children against my advice after arrogantly telling that my opinion on the matter did not count,” submitted the wife.


She further submitted that this was a proper case for the court to intervene and restore the joint estate’s assets, especially because it was clear that The trust was her former husband’s alter ego over which he had exclusive de facto control.


“His control of the activities of the trust enables him to juggle his affairs around to suit his convenience and evade liabilities and obligations to the joint estate and the children,” she stated. Tsabile was represented by lawyers from Magagula and Hlophe while appearing for Mamba was Zweli Jele.
