Walter Bennett suing MP Magongo for E200 000

MBABANE – Businessman Walter Bennett is suing outspoken Motshane Member of Parliament Robert Magongo for E200 000 for alleged defamation.

Magongo is yet to file his papers in court in response to the allegations.

In combined summons filed before the High Court, it is claimed that Magongo told Swaziland Railway CEO Gideon Mahlalela that Bennett was involved in problematic dealings linking the company.

Bennett is represented by Bongani Mndzebele from Magagula and Hlophe Attorneys in the matter.

Bennett, in his papers, denied such dealings. He claimed that Magongo’s statements were of a defamatory nature and wrongful.

He further submitted that Magongo made such statements with the intention to defame him and to injure his reputation and he succeeded.

He further argued that the statements were understood by people who were present when he made such, to mean that he is a corrupt and dishonest person.

"As a result of the defamation aforesaid, plaintiff (Bennett) has been injured in his good name and reputation and has suffered damages in the sum of E200 000," reads the summons in part.

He has further claimed payment of nine per cent interest per year calculated from the date Magongo received that summons to final payment and costs of the lawsuit. He claimed that Magongo had failed to pay him the amount despite lawful demand.

Magongo has been given 10 days to file a notice showing an intention to defend the case, if he disputed the claim.

He has also been informed that if he fails to file any papers, judgement would be entered against him without any further notice. The matter is still pending before the High Court.
