MBABANE – He is battling to be paid what is due to him.
Erstwhile Premier League of Eswatini (PLE) Chief Executive Officer (CEO) Simanga
Nhleko has filed a legal claim of over E1 million for alleged unfair dismissal
by the organisation.
This is according to legal documents submitted by his lawyer Mluleki
Ndlangamandla of MLK Ndlangamandla Attorneys at the Industrial Court yesterday
morning. The matter was heard before a panel of three magistrates but judgment
was reserved until further notice.
According to the documents, Nhleko was taking home E339 000 annually, with a
basic salary of E25 000, excluding benefits like travelling allowance drawn as
fuel (E1 500 monthly), communication allowance (E750) and E1 000 housing
allowance. The former Premier League referee is also demanding to be paid 30 per
cent gratuity of the E339 000 annual salary, which amounts to slightly over E1
million if calculated for the duration of his three-year contract. It has been
noted in the same papers that the two parties (Nhleko and PLE Executive
Committee) had not agreed on the payment of the gratuity.
“The offer, which was made to me and which I accepted, was for E25 000. It
comprised of the use of company car, communication allowance and then I
suggested accommodation allowance. We settled for accommodation allowance at E1
000, then gratuity, which was to be verified,” Nhleko stated in the papers.
Missing
He added that regarding the contract agreed upon, he raised some concerns about
certain elements that were missing. “As regards the contract, the salary was
as offered, the accommodation allowance as well was as offered, the
communication allowance was not per the agreement. A new benefit in the form of
petrol allowance was offered, but the company car issue was not on the contract,
so I advised the chairman verbally that the gratuity of 30 per cent was not
appearing on the contract as agreed upon. The chairman suggested that a meeting
would be convened to address the concerns, which I noted on the written
contract,” Nhleko further stated.
