Nosipho, who claims to be the biological daughter of the late businessman, has argued that the procedure now that Victor was dead would have to be that blood samples ought to be taken from the applicants. Applicants in the matter are Victor’s wife Lungile and her two daughters, Temalungelo and Tiyandza. They want the court to compel Nosipho to undergo a paternity test. In her answering papers, Nosipho contended that with Tiyandza and Temalungelo, purportedly being her father’s children, the process (DNA test) might jeopardise her now that Victor was deceased. Nosipho submitted that she was not sure if Tiyandza and Temalungelo were indeed the deceased’s biological children to be used as the reference point. “The second and first applicants (Tiyandza and Temalungelo) have no right in law to ask the court for orders that I should be exposed to paternity test when they are also purported children of the deceased, who have not proved their own paternity status,” argued Nosipho. She alleged that the duo had not placed any form of proof before the court that established that they were entitled to maintenance or inheritance in the deceased’s estate. Nosipho alleged that the only thing the two did was to state that they were born during the subsistence of a marriage between Lungile and the late Gamedze. She told the court that the applicants did not establish any grounds that overturned her rights to maintenance, inheritance, privacy, dignity and bodily integrity. “I take this move as harassment and not as a genuine move to find the truth,” emphasised Nosipho.
