The minor, *Gabi (14),who is an orphan, informed the court that she had attended a vigil and funeral service when she returned to find her uncle, Simanga Ndwandwe (29) infuriated. She alleged that the accused never asked her anything on the day of the incident but ordered her to strip her clothing. “When I refused to strip, he forcefully took all my clothes off and tied me with a rope around the legs. He tied me to the rafters facing down. He left me hanging from the roof and went outside to get sticks which he used to whip me all over the body. After the sticks broke, he got hold of an electric cable near the bed and thrashed me with it all over the body and I started bleeding. All this was happening while I remained tied upside down,” *Gabi alleged. She further alleged that after the assault, she tried screaming but she was too weak. When some of her siblings attempted to come to her rescue, she alleged that her uncle ordered them not to interfere in the matter as he was disciplining her for failing to return home. *Gabi also alleged that her uncle would leave the house, go outside and return to further assault her while she was still tied. “Eventually, I was untied from the rafters and fell onto the floor and injured myself. My uncle ordered me to clean the house, especially the floor and bed as it was covered in blood,” *Gabi alleged while fighting back tears. She added that on the following day, she reported the assault incident to the school head girl who informed the head teacher. The police were called and she was taken to the Raleigh Fitkin Memorial (RFM) Hospital, where she was admitted and treated for a week.
