This time the Industrial Development Company of Eswatini (IDCE) Limited is demanding a sum of E533 632.11 from Tee and Jay Woodworks. The money is in respect of an outstanding balance of a loan that was allegedly advanced to Tee and Jay Woodworks in May 2017. inform IDCE has issued summons by which the deputy sheriff for the Hhohho Region is to inform Tee and Jay Woodworks’ director, Thembinkosi Shaka Mndzebele, that it has instituted legal proceedings against him and his company over the alleged outstanding loan balance. According to the summons, the proceedings are instituted against Tee and Jay Woodworks and Mndzebele, who is the co-debtor of the former. IDCE informed Tee and Jay Woodworks and Mndzebele that the money is now due. Tee and Jay and Mndzebele are alleged to have failed, neglected or refused to pay IDCE. The veracity of these allegations is still to be tested in court. The respondents, Tee and Jay and Mndzebele, are yet to file their response to the allegations in the event they are opposed to the summons. jointly The claim against Mndzebele, according to IDCE, is due to the fact that he allegedly bound himself jointly as surety and co-principal debtor to Tee and Jay Woodworks for any or all debts owing by the latter to it (IDCE). “Plaintiff’s claim against the second respondent (Mndzebele) is for payment of E533 632.11 which he bounds himself jointly and severally as surety and co-principal debtor to the first respondent (Tee and Jay Woodworks),” reads the summons. IDCE further informed Tee and Jay Woodworks that if they dispute the claim and wish to defend the matter they should file with the registrar of the High Court within 10 days of being served with the summons, a notice of intention to defend upon being served with the summons. filed Their plea is to be filed within 21 days. “Inform the first and second defendants further that if they fail to file and serve notice as aforesaid, judgment as claimed may be given against them without further notice to them.” IDCE demands interest at prime rate 3.75 per cent from December 2019 to the date of final payment.
