MBABANE – Clubbers who lure people to dance with them and make sultry and seductive dance moves while partying stand to be arrested.


Both male and female clubbers who are found to have acted inappropriately in terms of unwanted sexual dance moves may just find themselves in hot water.
They could be charged in accordance with the provisions of the Sexual Offences and Domestic Violence (SODV) Act 15/2018 under Section 48(1).


Section 48(1) provides as follows; a person who sexually harasses another commits an offence and shall, on conviction be liable to pay a fine not exceeding E25 000 or to imprisonment for a period not exceeding 10 years or both.


Section 2 states that sexual harassment is committed where; a person subjects another to an unsolicited act of physical intimacy, including but not limited to, physical contact such as patting, pinching, or touching in a sexual way or unnecessary familiarity such as deliberately brushing against another.
In the case of clubbers, they may be found to be contravening the Act if they physically contact another by dancing suggestively or deliberately brush against her in a sexual manner, without her consent.


Touching


In most cases, in a nightclub setting, the lights are dimmed, the music is loud and space is tight, which makes it hard for a proper conversation to take place without actually touching one another. Male dancers usually approach females on the dance floor with the hope of dancing with them throughout the night, even if they are unknown to them.


Most revellers also tend to try out various dance moves, including the seductive ones.
One such popular dance move that most females enjoy doing is the popular twerk, a dance characterised by shaking the buttocks.
In most instances, a male fun lover would approach the female from behind and join her by brushing against her buttocks in a suggestive manner, though oblivious that this could be an offence.


Some male clubbers even take it a notch up and buy drinks for their female companions or dance partners.
Furthermore, it is common practice in most dance floors for a male fun lover to touch a woman’s body parts such as her hips and waist while dancing with her. However, the SODV Act frowns upon such behaviour, especially if the female fun lover did not consent to the suggestive, sexual dance moves.
