SWAZI JIVE TAKES SNYC TO COURT

MBABANE – Swazi Jive Entertainment is taking Swaziland National Youth Council to court for a E48 176.40 bill.


The Swaziland National Youth Council (SNYC), a council established in accordance with the laws of the Kingdom of Eswatini, is being taken to court by Swazi Jive Entertainment. This is over allegedly owing them a sum of E48 176.40, according to combined summons submitted at the High Court of Eswatini.
Swazi Jive Entertainment, being the plaintiff, claims against Swaziland National Youth Council which in this case is the defendant, for the relief and on the grounds set out in the particulars of claim annexed hereto;


Agreement


On or about September 2017, the parties in Mbabane entered into a verbal agreement to launch the National Youth Summit. Swazi Jive Entertainment was represented by Sakhile Nkambule, who is the Director while the Swaziland National Youth Council was represented by Makhosini Dlamini, who is the Chief Executive Officer. The two had an ostensibly necessity to enter into an agreement.
This agreement went as follows:


Swazi Jive Entertainment would provide services to launch the National Youth Summit in November 2017 which is an initiative by the Swaziland National Youth Council to provide for socio-economic development for the youth.


Swazi Jive Entertainment would engage all necessary stakeholders to represent at the launch so as to ensure the success of the event.
Swazi Jive Entertainment would secure and provide items and services such as branded T-shirts, branded banners and launch venue for hosting a successful launch event.


Swazi Jive Entertainment would provide event design and management on behalf of the Swaziland National Youth Council.
Swaziland National Youth Council on the other hand would make payment on demand upon Swazi Jive Entertainment fulfilling its obligations in respect of hosting and managing a successful launch event.
Summons
Swazi Jive in the combined summons claims that they provided the Swaziland National Youth Council with 50 branded T-shirts at the cost of E4 000, two pull up banners at the cost of E4 560, a venue for the launch at the cost of E11 700 and launched the event at the total cost of E22 000.
The papers state that the council was duly served with an invoice of the said amounts encompassing the statutory requisite of 14 per cent value added tax in the amount of E5 916.40 making the total amount owed by Swaziland National Youth Council to be E48 176.40.
It is worth noting that the matter is still in the chambers of the court and Swazi Jive Entertainment is represented by Magagula and Hlophe attorneys.
