DJ CUP DEMANDS E7.7M FROM GOVERNMENT

MBABANE – Shot by the police in what was a case of mistaken identity, DJ Cup is demanding over E7.7 million from government.


The DJ, born Welcome Zama Maseko (25) of Siphocosini, was shot by the police on December 18, 2016 near Nhlambeni in the early hours of the morning while returning from a nightspot in the Shiselweni Region with two other companions where they performed.
The police later allegedly admitted in articles published in the Times of Swaziland on December 20, 2016, to have blundered in the manner the DJ was shot.


Maseko, who is represented by Machawe Sithole of Sithole and Magagula Attorneys, has taken the National Commissioner of Police, Isaac Magagula, and government to court.
The actual amount he is demanding from government in E7 730 000, which is the damages he allegedly suffered as a result of the shooting incident. In his particulars of claim, Maseko submitted that he was severely injured when the police allegally shot at the motor vehicle he was travelling in. He said the shooting was without any justification.


The DJ told the court that he was shot in his thigh and he sustained a fracture in his bone. Maseko informed the court that he sustained severe injuries to his upper and lower limb.
“As a result of the aforesaid shooting, the plaintiff (Maseko) was injured and suffered permanent disability on his leg,” reads part of the combined summons.
He was hospitalised for four weeks at the Raleigh Fitkin Memorial Hospital where an iron rod was inserted in his leg. Maseko has still not fully recovered and he walks with the aid of crutches.


The shooting incident and subsequent injuries, according to Maseko, have rendered him unable to perform as a disc jockey, which he did as private work, and he also could not obtain a study permit to complete his Electrical Engineering course at the Vaal University of Technology.
Maseko alleged  that the police acted negligently and recklessly. He said they were at all material times acting within the course and scope of their employment, making the Swaziland Government vicariously liable for their act.
 The DJ has served a statutory letter of demand to the defendants (government and the national commissioner) and he alleged that despite lawful demand, government is refusing and or neglecting to pay the amount he is claiming.
On the day Maseko was shot, the police earlier on responded to a report of a home invasion at Mawelawela in the outskirts of Hlatikhulu.
