UMDABULA DIRECTOR OPPOSES E66 000 LAWSUIT

MBABANE – Umdabula Festival is defending the E66 000 lawsuit against it instituted by a company which provided T-shirts to its Director Mbekezeli Zulu.


Through his attorney, Umdabula Festival’s Director Zulu has filed a notice of intention to defend the suit.
Zulu’s lawyer Bongani ‘Bhanyaza’ Mdluli yesterday indicated that there were chances that the matter would be settled out of court if the parties reach consensus.


Zulu had been given 10 days to file this notice or a default judgement would be made. 
His lawyer went on to confirm that they were currently engaging Thapel Investment’s lawyer and further said the matter is likely to be settled out of court, as per the talks that they have had with the plaintiff’s lawyer.


The alleged agreement between Thapel Investment and Zulu was that the T-shirts would be purchased at the price of E76 000. Zulu is alleged to have paid only a sum of E10 000 for the purchase of the T-shirts.


According to the combined summons, in December last year, Zulu and the company which was represented by Thandiwe Ntshalintshali, concluded an agreement for the supply of a total of 365 T-shirts on December 31, 2016. The purchase price, according to the agreement, was to be paid in full on December 31.


On New Year’s Day, Zulu acknowledged his indebtedness in writing to Thapel Investment and further allegedly agreed to make full payment of the balance on or before February 28, 2017.
In the acknowledgment of debt signed by both parties, Zulu agreed that in default of payment, the company would be entitled to approach the courts for an order for payment of the debt.
