PUB & GRILL EJECTMENT GOES AHEAD

MBABANE – The efforts of Pub & Grill to reverse the order to be ejected from The Gables has failed.     This comes after the court dismissed the application to rescind the final order for ejectment of the famous eatery from the premises where it operates a pub and restaurant.

The application for rescission was heard and dismissed by Judge Doris Tshabalala. A recession is an application wherein an aggrieved party files papers for the court to set aside its previous decision.


 The granting of the ejectment order resulted in deputy sheriff locking the premises armed with the court order a fortnight ago. The Ezulwini-based popular eatery and watering hole had opposed the application to be ejected from the premises. This was done through its lawyers from Magagula and Hlophe Attorneys after an interim order had been issued by Judge Tshabalala.


Judge Tshabalala had issued an interim order directing a deputy sheriff to attach all movables and make an inventory thereof.  The judge also interdicted the removal of any movables from the premises. The court also ordered the eatery to pay the money it allegedly owed in respect of rental arrears.


She further ordered that Pub & Grill should be ejected from The Gables, Galleria Shopping Centre at Ezulwini. The filing of the notice of intention to oppose the order came after the court called upon the company to show cause why the interim order should not be made final.


The deputy sheriff had earlier attached a number of items belonging to the company. The attached items included alcoholic beverages and other movables. The attachment meant that the items could not be removed from the premises pending finalisation of the matter.  Notably, Pub & Grill’s core business is selling food and beverages.


The list of the attached goods was forwarded to the court by the deputy sheriff. The order by the court came after  The Gables (PTY) Limited, which owns the building where Pub & Grill operates its business, instituted legal proceedings where it was demanding E433 641. 31 in respect of arrear rentals. This order was also granted by the court. 


In its application, The Gables (PTY) Limited alleged that from the month of July 2016, Pub & Grill had defaulted in paying its monthly rentals regularly or had not paid them at all for the premises it occupied.
