TWO COMPANIES FIGHT OVER E140 000 PAYMENT

 MBABANE - The two companies which were involved in the construction of 16 houses at Sithobelweni Health Centre, are at each others’ throats. Thando’s Investment (PTY) Limited has since instituted legal proceedings against ZMT Investment (PTY) Limited.


The plaintiff (Thando’s Investment (PTY) Limited) wants the court to compel the defendant to pay it a sum of E139 434.88 for allegedly supplying and fitting furniture into the houses.


In its particulars of claim, the plaintiff alleged that on or about March 2017, it entered into a verbal agreement for the supply and fitting of furniture into houses built by the defendant at Sithobelweni Health Centre.
The houses, according to the plaintiff, comprises of two bedrooms, sitting room, toilet, bathroom and a kitchen.


Conclusion


During the conclusion of the agreement, plaintiff was reportedly represented by its Director Thando Dlamini and the defendant was represented by its Managing Director Mcebo Kubheka.
The plaintiff submitted that the material terms of the agreement, were that it was to supply and fit wooden wall wardrobes, kitchens cabinets and linen cupboards on 16 two-bedroom houses constructed by the defendant at Sithobelweni Health Centre.


Averred


Thando’s Investment (PTY) Limited averred that it was to fit the houses as follows; each kitchen fitted with cabinets at a cost of E23 806.20 per kitchen, each house fitted with linen cupboards at a cost of E950.78 per house and each bedroom fitted with wooden wall wardrobes at a cost of E5 670.10 per wall wardrobe.


The total amount of the work that was to be done, according to Thando’s Investment (PTY) Limited was E577 554.88. 
The defendant was to make a down payment of 60 per cent before work could commence.


 The plaintiff, according to the agreement, was to issue an invoice on completion of work and defendant was to pay the invoice within seven days of receipt on the invoice.


Paid


The plaintiff informed the court that on March 13, 2018, the defendant paid it down payment of E300 000.
Plaintiff alleged that it proceeded to supply and fitted the kitchen cabinets, wooden wall wardrobes as well as the linen cabinets in all the 16 houses built by the defendant at Sithobelweni Health Centre.
On July 18, 2017, the defendant reportedly paid a further E100 000 in projects fees, bringing the total payment to E400 000.
Upon completion of work around September 2017, the fitting were duly inspected by the defendant and there were allegedly no queries on the accuracy of the work done.
