PMT SUED FOR E1.4 MILLION

MBABANE – Misery loves company.

This is the best axiom to describe the situation faced by PMT (PTY) Limited and its Director Philani Macbeth Tsela. A businesswoman has instituted legal proceedings against the company and Tsela, where she is demanding payment of over E1.4 million. The exact amount which the businesswoman, Tegentile Simelane is demanding from Tsela and his company is E1 428 050. In her particulars of claim, Simelane alleged that the aforementioned amount was in respect of a loan she advanced to Tsela and his company.

She averred that despite several demands and reminders, Tsela had refused and/or neglected to pay her money back. In the simple summons issued by Simelane’s lawyers, Tsela and the company have been informed that in the event they dispute the claim and wish to defend, they should within 10 days file their notice of intention to oppose. “Inform the defendants ( Tsela and his company)  that if they fail to file and serve a notice as aforesaid, judgment as claimed may be given against them without further notice to them,” reads part of the court paper.

Simelane is represented by lawyers from MP Simelane Attorneys. This is not the first time for Tsela and his company to be taken to court over money. In April this year, the court granted an order in favour of Standard Bank in its matter against PMT (Pty) Limited and Tsela. The issuance of the summary judgment came after the bank took the businessman and his company to court where they were demanding E2.4 million. A summary judgment (also judgment as a matter of law) is a judgment entered by a court for one party and against another party summarily, that is, without a full trial.
