STANDARD BANK VICTORY AGAINST PMT

MBABANE – The court has granted an order in favour of Standard Bank in its matter against PMT (Pty) Limited and its Director Philani Macbeth Tsela.


The issuance of the summary judgment comes after the bank took the businessman and his company to court where they were demanding E2.4 million. The summary judgment was granted by Judge Nkululeko Hlophe on April 27.


A summary judgment (also judgment as a matter of law) is a judgment entered by a court for one party and against another party summarily, that is, without a full trial. Such a judgment may be issued on the merits of an entire case, or on discrete issues in that case.
In papers filed in the High Court, the bank said the two defendants approached it for an overdraft which was advanced on May 24, 2016.
Under the first claim the bank was demanding payment of the sum of E1.2 million which was in respect of the overdraft.


The bank alleged that the monies were now due and owing as at January 26, 2018 and the defendant was neglecting or refusing to pay the money despite demand.


Under Claim B, Standard Bank is demanding payment of E103 284.63 which was allegedly in respect of a personal loan lent and advanced on April 25, 2015 by the bank to Tsela.


The bank is further demanding “payment of the sum of E1 099 621.86 being in respect of a home loan advanced to the second defendant (Tsela) on August 20, 2013 by the plaintiff at the latter’s special instance request which monies are now due and owing as at January 26, 2018.”


Standard Bank is also demanding payment of E19 486 which was allegedly in respect of a credit card facility advanced by the plaintiff to Tsela at the latter’s special instance request and the money was also due or owing as at January 26, 2018.
The total payment of E2 422 392.09, according to the affidavit, was now due.
