ZMCK ENGINEERS’ E280 000 PIGG’S PEAK TENDER

 MBABANE – ZMCK Consulting Engineers stands to be granted the E280 000 tender for the supervision of the Pigg’s Peak Town Council delivery road.


Tender results issued by the Swaziland Public Procurement Regulatory Agency (SPPRA) reflect that engineering consultancy firm scored a whopping 96.98 per cent during the evaluation exercise undertaken by the Pigg’s Peak Town Council.


ZMCK outsmarted Bicon Consulting Engineers and Swaziland Consulting Engineers to be enlisted as the best evaluated tenderer.
It should be noted that none of the evaluated tenderers below 80 per cent on average. Swaziland Consulting Engineers closely followed scored ZMCK as they scored 88.2 per cent while Bicon amassed the lowest marks as they were rated at 87.6 per cent.


The exact amount of money that will be paid to ZMCK for executing the supervision task at hand is E280 225.
In the intention to award issued in accordance with the Public Procurement Act of 2011 it was explained that all tenderers were being given a period of 10 working days to make any applications for review of the evaluation results.


“The contract award decision does not constitute a contract,” the municipality’s tender board clarified.
In terms of the act used when issuing the contract award decision, the SPPRA should be informed by the procuring entity of any procurement to be undertaken, be informed of the intention to award a contract and also be informed on whom the tender has been awarded to but this hardly happens with a lot of government institutions which makes it hard for the agency to execute their mandate.


In terms of the Section 10 (c) of the Public Procurement Act of 2011, the mandate of SPPRA includes monitoring compliance with the act and procurement performance by procuring entities, conduct audits of any procurement activities (compliance and performance audits) and investigate the conduct of any procurement activities suspected to involve violations of the Act and regulations.
The agency also refers breaches of the act to the relevant budgetary, oversight and law enforcement bodies.
