GUARD ALERT TAKES ON NKONYENI SPAR

MBABANE – Its trouble again for Nkonyeni Spar. Guard Alert Security Services is now demanding E82 533.73 in respect of security services it rendered at the premises of the shopping outlet.


Through its lawyers from Waring Attorneys, Guard Alert Security Services has instituted legal proceedings against defendant (Nkonyeni Spar) at the High Court.


In its particulars of claim, the applicant alleged that on or about November 2015 the parties concluded an oral agreement of service. According to the combined summons issued by the security services company, during the signing of the agreement it was represented by its Director, Christopher Scott- Long and the defendant was represented by a certain Mr Jacobs.


These are allegations contained in particulars of claim whose veracity is still to be tested in court and the defendant is yet to file its papers in the event it is opposing the application.


It is alleged that the material terms of the agreement between the parties were as follows: The agreement would endure for an indefinite period of time from its inception in the year 2015; plaintiff would provide security services to the defendant at the defendant’s business premises situated at Nkonyeni. It was also the tacit terms of the agreement that the plaintiff would issue a monthly invoice to the defendant for 30 days from date of receipt of the invoice.


Guard Alert alleged that pursuant to the conclusion of the agreement, it duly provided its security personnel for both the day shift and night shift at the defendant’s place of business. 
The plaintiff claimed that it duly issued invoices for the services rendered. On July 24, 2017 the defendant is reported to have attended to payment in the amount of E60 000.
