TIME CATERERS WANTS OVER E700 000 FROM KUKHANYA
MBABANE – Time Caterers wants over E700 000 from Kukhanya Civil Engineering Contractors in respect of food that it allegedly supplied to its employees.
The catering company has since decided to seek legal recourse where it is seeking an order compelling Kukhanya to pay it a total amount of E732 308 64.
In its particulars of claim Times Caterers stated that on or about May 17, 2016 it entered into a written service level agreement with the defendant (Kukhanya Civil Engineering Contractors).

The plaintiff (Time Caterers) alleged that when the agreement was entered into, it was represented by its Director Sipho Thwala while Kukhanya Civil Engineering Contractors was represented by its Corporate Affairs Manager Welile Shongwe.
According to the plaintiff, the material terms and condition of the agreement were that: the plaintiff would on credit basis provide catering services to the defendant at the latter’s Nhlangano – Sicunusa Road project site, the defendant would provide plaintiff with a menu for the food to be supplied to it, the plaintiff would charge each meal at the rate of E25 and that the plaintiff would submit its invoices for payment purposes to the defendant by the 25th of each month,.
It was allegedly also agreed between the parties that the defendant would pay E25 per meal multiplied by the total number of its employees on site for the respective months.
In the particulars of claim it is alleged that by way of correspondence dated July 15, 2016 the parties agreement was extended for a period of 12 months up to June 15, 2017.
