ASD TAKES ON GOVT OVER DELAYED LABOUR COMPLIANCE CERTIFICATE

MBABANE – “The Company is now unable to tender for government contracts as a result of the spiteful conduct of the Labour Commissioner and his officers.”


This submission was made by a company which claims to be unable to tender for works because the Labour Commissioner allegedly refused to issue it with a labour compliance certificate.


Tendering


ASD (PTY) Limited, based in Matsapha, is involved in the tendering business with the Swaziland Government in the supply and delivery of pipes, fittings and building materials.
In order to be considered for a tender, it should also have a labour compliance certificate, which as per norm, becomes one of the requirements.


The company claimed that a number of tenders had been rejected already.
It has also pointed out that it wants to tender for a job that was due on or before November 3, 2017.
The tender is for delivery of construction and maintenance materials for the financial year 2017.


Directing


ASD (PTY) Limited has since taken the Minister of Labour and Social Security Winnie Magagula and Labour Commissioner Sipho Tsabedze to court.
It is seeking an order directing the Labour Commissioner to forthwith issue it with the Labour Compliance Certificate in order to carry on their business.
