Boy (16) found guilty of culpable homicide

MANZINI - A 16-year-old boy was found guilty of unintentionally killing another with a stone which hit him above his left eye.

*Mandla of Ludwala, Ngwane Park appeared before Principal Magistrate David Khumalo yesterday.

He pleaded guilty to culpable homicide.

He committed the offence on December 12, 2011 at Ngwane Park and Lother Dubber (18) died at Mkhiwa Clinic as a result of the injuries sustained from the incident.

Mandla told the court that he was defending himself after the deceased overpowered him during a fight after he heard him gossiping about him with a friend.

The deceased’s uncle Pevin Dubber also led evidence and told the court that he received a phone call from the friend telling him that they were at the Raleigh Fitkin Memorial Hospital (RFM) and his nephew was injured.

"We rushed to the hospital and found him at the card room trying to get his card. We decided to go to Mkhiwa Clinic as he was on medical aid where he was admitted for a week. Scans were conducted and after the seven days he was discharged from the hospital," Dubber said.

He also said Lother complained of a severe headache three days later and was taken to the same hospital where he fainted upon arrival. Dubber said his nephew was rushed to the emergency department, however, he passed away on the same day at midnight.

"On the following day as a family, we went to the police station and laid a charge against the suspect as we knew him and had gone to his home to find out the cause of the fight.

Constable Ndumiso Myeni informed us that he had been arrested for committing the offence," Dubber said.
