Former PS Magongo arrested for DD' again
MBABANE – The recently retired Principal Secretary in the Ministry of Home Affairs, Mduduzi Magongo has been arrested for drink-driving.
This is the second time for Magongo to be arrested for contravening Section 91 of the Road Traffic Act.
The section provides that a person shall not drive on a public road or occupy a driver’s seat of a motor vehicle whether the engine is running or not while the concentration of alcohol in his/her specimen of breath is 0.38 milligrams per litre.
This time the former PS was arrested on Monday next to the Swaziland Royal Insurance Corporation (SRIC) building and the reading of the alcoholmeter was 0.89mg/l.
However, upon his arrest he was not detained, but was allowed to pay bail of E1 500 and yesterday he appeared at the Mbabane Magistrates Court.
He did not appear in open court, as his case was heard inside the chambers of Magistrate Phathaphatha Mdluli.
Magongo pleaded guilty and was sentenced to 15 months in prison with an option of a E1 500 fine.
He was, however, treated as a first offender as there was no evidence that was brought forward by the prosecution to the contrary.
In mitigation he pleaded that the court be lenient because it was not his intention to commit the offence.
The E1 500 bail he paid at the Mbabane Police Station upon his arrest on Monday was converted to the fine.
