Grade IV pupil arrested for raping classmate
SITEKI - A 15-year-old Grade IV pupil at in the Lubombo region has been arrested for allegedly raping a classmate three years younger than him.
*Vusi allegedly raped *Titi, 12.
He allegedly committed the offence last week Tuesday.
The two are said to have been coming from school when Vusi allegedly forced Titi into the nearby bush and raped her. After the incident, Titi is said to have rushed home where she reported her ordeal.
Shocked family members are said to have called the police, who promptly arrived and took Titi to hospital for a medical check-up.
Vusi was later arrested and he yesterday appeared before Lubombo Senior Magistrate Donald Mavuso.
Since he is still classified as a minor, his guardian was called to stand with him in court.
When his rights of legal representation were explained to him, he elected to conduct his own defence.
He was not asked to plead to the charge since the prosecution applied for a postponement to gather some evidence.
Senior Prosecutor Mbutfo Mamba further applied that the accused be remanded out of custody since he is a minor, adding that his guardian should make sure that he does not abscond from trial.
The prosecutor’s application was not opposed by the senior magistrate, who further warned the guardian to make sure that the accused did not interfere with state witnesses.
"I am going to release him so he can be under your guidance and I want to make it your responsibility that he does not abscond trial. You are also tasked to make sure that while the accused is out of custody he does not interfere directly or indirectly with state witnesses," said Mavuso.
Magistrate Mavuso further stated that the case will be postponed to a date that will not coincide with schooldays so the accused can attend school.
The matter was postponed to August 21.*Not their real names.

I'm suprised how the jugde can classify this rapist as a minor and be remanded out of custody. Its like his education comes first than the trauma and pain he caused the little innocent girl,are kids around him safe, age is just a number this is a rapist he should be in jail before he rapes onother little girl and this is possible because he didnt experience something that can be lesson of his life.

We can say he raped him...but what if these two were dating as we know dat our kids of today practise things at an earlier stage??....and d girl was afraid that the others saw her..n she lied...im defending no one........bt if he did....he needs to b punished in a way dat wil teach the others..because now our kids wil be afraid to attend skul

The magistrate was wrong to release this boy. He's life is in danger. Inhlitiyo ayilali namutfu, letakhamuti titomshaya lomfana. Phela what he did kuyenyanyeka. Raping a defenseless little girl, i'm really hurt. Iphindze isale kitsi batali. Lisango alivuke, liguma livuke, lets not leave everything to the teachers but we also have the responsibilty to talk to our kids ngekutiphatsa.
